Terms of carriage
These terms apply to all journeys booked with Auto Günther des Messner Günther via this website, by phone, by e-mail or via WhatsApp.
1. Service and scope
We provide passenger transport as a private hire service with driver (NCC). Journeys are carried out exclusively on prior booking.
2. Conclusion of the contract
Your request via the booking form is not yet a binding booking. You first receive an acknowledgement of receipt. The contract is concluded only once we expressly confirm the journey. If we do not confirm within 24 hours, the request is deemed not accepted.
3. Prices
All prices shown are final prices in euros and include Italian VAT.
The price calculated in the booking form is a guide value. Traffic, diversions and the route actually driven may affect the final price. The price stated in our booking confirmation prevails.
In the event of significant increases in fuel prices, the prices shown may increase accordingly.
4. Payment
Payment is made after the journey directly in the vehicle, either in cash or by debit or credit card. A card terminal is on board. Advance payment via the website is not offered.
5. Cancellation and no-show
You may cancel free of charge up to 7 days before the agreed date. The time your message by phone, e-mail or WhatsApp reaches us is decisive.
For later cancellations, or if the journey is not taken without notice, we may charge the agreed fare. Expenses saved and income earned otherwise are credited against it.
If we are unable to carry out the journey for reasons within our responsibility, we will inform you without delay and endeavour to arrange an equivalent replacement through a partner company. Any payments already made will be refunded.
6. Waiting times, delays and airport transfers
Please be ready to depart at the agreed place and time.
For pick-ups at airports and railway stations we take flight or train delays into account, provided you have given us the flight or train number. Beyond one hour of waiting we may charge a surcharge, which we agree with you in advance where possible.
7. Luggage, sports equipment and animals
Luggage, sports equipment such as skis, snowboards, road bikes or mountain bikes, and the carriage of animals must be stated at the time of booking so that we can allocate a suitable vehicle. Undeclared bulky luggage or undeclared animals may be refused if there is not enough space in the vehicle or carriage would be unreasonable for other passengers.
8. Passenger obligations
The driver's safety instructions must be followed. Seat belts are compulsory for all occupants. Smoking, including e-cigarettes, is prohibited in the vehicle.
You are liable under the applicable law for damage to the vehicle or its interior culpably caused by you or your companions, in particular for soiling that requires special cleaning.
9. Luggage and valuables
Please point out any already damaged luggage when loading. Fragile items, souvenirs, valuables, cash, jewellery, medication and electronic devices belong in your hand luggage and should be carried by you personally. We are not liable for damage to such items in checked luggage unless we are at fault.
For damage caused intentionally or negligently by us or our agents, and for injury to life, body or health, we are fully liable under the applicable law.
10. Right of withdrawal
There is no statutory 14-day right of withdrawal for passenger transport contracts. Contracts for passenger transport services are largely excluded from the scope of the distance selling rules (Art. 47(2) of the Italian Consumer Code, Legislative Decree 206/2005); in addition, the right of withdrawal does not apply to services to be provided on a specific date (Art. 59(1)(n) of the Consumer Code). The cancellation terms under point 5 apply.
11. Complaints
Please address complaints to autogunt70@gmail.com or by phone to +39 327 881 3667. We aim to resolve them promptly. For disputes arising from consumer contracts, the conciliation and mediation service of the Chamber of Commerce of Bolzano is also available.
12. Applicable law and place of jurisdiction
Italian law applies. For consumers, the court at the consumer's place of residence or habitual abode has jurisdiction. Mandatory consumer protection provisions of the country in which the consumer is habitually resident remain unaffected.
